DBSK's contract details were revealed on omgkpop.com. It's actually disgusting, I'd read with caution, it made me queasy. SM Entertainment is revealing the contracts they have with the celebrites within the company. It's DBSK-SM contract but it's a typical contract format so it applies to all SM singers.
- DBSK will follow the instructions of the assigned manager unconditionally. Contracts and promises of activities cannot be done personally.
- You are not allowed to reveal anything that goes on inside to anyone on the outside.
- If there are any setbacks or failures to do a broadcast or performance without a good reason, DBSK is responsible for the disruption.
- A regular album should be produced twice a year.
- Six months before the end of the contract, a new album must be released. All entertainment activites should be accomploshed.
- Any third parties that would like to write for DBSK will have to get permission from SM. However, even without getting the consent of DBSK, SM can give any singer inside SM the song DBSK produced themselves.
- Any days an activity is posponed due to a personal reason, those days will be added on to the length of the contract.
- 50 000 - 100 000 copies sold = 2% of the revenue. 100 000 - 200 000 copies sold = 3% of the revenue. 200 000 and above = 5% of the revenue. Of course, the percentage of the revenue given will be split accordingly within DBSK.
- If you are not the permanent guest of a show, you will not get paid for the appearance on the show. (For example, being a guest on shows like "Family Outing" and "Come Over" will not be paid)
- In the even of early termination, DBSK has to pay three times what SM invested in them and two times the revenue they will miss out on, even if they agreed on the termination and even if it is SM's fault.
- DBSK's manager, food costs, coordinater costs will be paid by DBSK.So, they aren't being paid for TV appearences or for only a particular amount of albums sold (which at the most, they each get 1% -_-) and yet they have to pay for their manager, food and if their contract is terminated early even if it's SM's fault. AND they can just steal their songs! Wtf. There was also an article on allkpop.com about their income. With the court agreeing on the injunction sent by the 3 members of TVXQ, the trio had the power to look at SM Entertainment's contract for the members. It was shockingly unfair and against public policy. The three members who stood up for themselves (Kim Junsu, Kim Jaejoong, and Park Yoochun) have the court on their side and are now proceeding with their main lawsuit, which is to get the shares and income that they deserve from their activities in the past 6 years.
Below is what the court has presented as the content of the members' contracts. The contract has been modified 5 times since their debut, so this is the overall review.
1. TVXQ has received $0 from their album sales till July 2008, and a very small amount after.
Before the fifth modification that the company made with their contract, it stated that the profit from albums and singles with sales less than 500,000 copies would go 100% to SM Entertainment, which left the members with nothing. There has been no Korean album that have exceeded 500,000 album sales between the time of TVXQ's debut and their 4th album Mirotic, which was the first album in Korea to sell over 500,000 albums for a long time.
On July 1 2008, the company changed the contract so each member would get 1% from album sales that exceeded 200,000 copies. For albums that are below that number, they are paid 0.6% to nothing. Through these terms, TVXQ has not earned a single cent since February 2009.
2. TVXQ has received $0 from sales of concert DVD's and albums with recordings from concerts.
The contract stated that the members are not entitled to get any profit from concert DVD's and "live" albums.
3. TVXQ received $0 from their appearances in TV programs.
In the contract, the members do not have a right to receive the shares made from appearances on television programs if they are featured in only one episode or if their appearance is temporary. SM has kept all the profit from TV shows where TVXQ were guests.
4. For other ways of getting profit, SM subtracts the total amount with all the expenses that the company has paid for them, including clothing, salary of company staff, stage preparation, rent, food expenses, and etc., which only leaves a fraction for the members of TVXQ.
As for all other sources of income, the contract says that the members do not get the full "net income", but only get a percentage of it. The contract states that the "net income" is the profit remaining after deducting their operating costs, which is the money that the company spends on them. The operating costs include expenses that are to be covered by the employer, such as salaries of the staff (manager, clothing coordinators, makeup artists, dance coordinators, back dancers, etc.), performance stages, living expenses which include water and electricity bills, travel expenses which include plane tickets, and meal expenses. The company might add something in addition to deduct more from the net income.
In conclusion, TVXQ actually received anywhere from 1% to 5% from all of their activities, which depending on how you look at it can still add up to 7 figures or more but still many consider this to be unfair.Stupid Lee Soo Man. Stupid SM Entertainment. I feel like puking, brb.

Not necessarily. Too many people have made points that are just as valid on the side of SM. However, I'm not just saying that because Yunho and Changmin (supposedly my two most valued members) are 'apparently' on their side, but because yes, they could possibly be using the 'slave' contract as a cover up for their beauty products thing. Then again, their contract was still extremely unfair, but that could just be their fault for signing it despite the fact they were young. AND they've quit the beauty product company now. It's just a backwards and forwards argument with no one admitting to anything. We won't find out if we still have a band until the 12th of November. If we don't it'll just be Changmin and Yunho, which makes no sense what so frickin' ever and SM will probably be hated for the rest of their lives and about a million protesters will try and kill Lee Soo Man.
So all-in-all, let's just hope the trio agree to having it sorted by the 12th. They're the ones that are concered for the fans anyway. Jesus.
